Spotlight Session: Changes to the Procurement Act and Potential Impacts for the Supply Chain

We are thrilled to announce that this Spotlight Session will feature Graeme Young, a distinguished partner at CMS. In this insightful session, Graeme will focus on the critical implications of recent
changes to procurement law on the supply chain. As we navigate the transition into AMP8, understanding these legal nuances becomes paramount for all stakeholders.
Graeme will unravel the legal landscape, shedding light on how procurement law changes
could impact the supply chain. Key points to be explored during the session:
- Provisions on excluded and excludable suppliers and how they should be dealt with by contracting authorities. This will cover issues such as poor performance and non-improvement despite opportunities to do so.
- A significant departure from past regulations, wherein suppliers can now face exclusion based not only on their own performance but also on the status of associated suppliers and subcontractors.
- Introduction of a central debarment list, empowering a Minister of the Crown to list suppliers falling under exclusion criteria.
- Mandate for contracting authorities to publish at least three key performance indicators (KPIs), with obligations to assess supplier performance against these metrics and share related insights.

Graeme is a partner in the CMS Competition & Trade team, with over 20 years’ experience advising a wide range of clients on competition law and antitrust issues. On procurement, he advises public sector bodies, utilities
and bidders on the regulated tender processes and on challenges to award decisions. He is particularly well known for his work in the life sciences, healthcare, utilities, public infrastructure and regeneration sectors. Graeme has advised a number of the major water companies on procurement issues, including the procurement of strategic capital frameworks to support investment programmes, major IT procurements, PPP/PFI projects, energy and hydrogen
projects and Ofwat’s direct procurement for customers (DPC) model.
